All transaction are governed under the laws of the State of California which apply to and interpret your and SuperiorPowersports.com’s rights, duties, and obligations arising from these transactions, as supplemented or modified by this Agreement, without regard to conflict of law principles. We have the right to refuse service.
SuperiorPowersports.com will only accept your order only if you accept the terms of this SuperiorPowersports.com Acquisition Agreement (“Agreement”),

Ridewest Powersports, Inc. is a licensed and bonded authorized powersports dealer in the state of California.
We always strive to provide the most excellent service for all of our customers to ensure that you have the most satisfiying buying experience from our dealership.

Protecting Our Customer From Identity Theft
To protect the privacy and identity of our customers, We strongly encourage you to use billing address as shipping address to avoid any delays on processing your order, when placing an order online if you request to have the merchandise shipped to a different address other than the billing address the customer must confirm with his/her credit card Company that they have added the shipping address as an alternate address. This can be done by calling the credit card phone number on the back of the card and ask the credit card provider to add the shipping address as additional address on the card.

If your billing address and shipping address are the same, you don't need to do anything.

Order Cancellation
After placing your order, you may cancel your order within 24 hour without any charge. If you would like to cancel your order please email us your order cancellation request to manager@SuperiorPowersports.com please call us to confirm that we received your cancellation request. SuperiorPowersports.com starts to process your order on the same business day. Order Processing include address verification, shipment document preparation, charge your credit card and warehouse prep of your order. Therefore, if you want to cancel your order after 24 hour, you will be subject to $100.00 order cancellation fee. Once your item has been picked up by shipping company, your order cannot be cancelled. If you choose to cancel your order or refuse delivery after your order has been shipped, you will be responsible for "To and From Shipping and Handling Charges" incurred in shipping your order and a 25% restocking fee.

Return & Exchange Policy
We want you to be completely happy with your purchase. Your unused item(s) may be returned or exchanged within 14 days of receiving your item. Simply follow the guidelines below. Please note no refunds or exchanges will be made after the return/exchange period. No returns on accessories and parts. After the 14 days the sale is final. We will accept the return or exchange of the item only if it is unused (not fueled) and in original box unassembled for a refund in full less the shipping and handling fee to and from and 15% restocking. For items that have been P.D.I Assembled and tuned your refund will be in full less the shipping and handling to and from and a 25% restocking fee. If you have received your vehicle for more than 14 days and or have used it, you are not eligible for a refund or exchange. Refunds will be issued after we receive the returning item. Any unauthorized return will not be accepted.

Shipping / Shipping damage Policy
All orders are processed between 24-72 business hours. Please allow 3-5 additional days for orders with PDI and assembly and tune-up. Slight delays may occur during the holidays. All merchandise will be shipped by professional LTL trucking company. Estimated delivery time is 2-10 business days depending on what state you are in, because there are unforeseen problems that can occur we can make no guarantees on an exact delivery date and time. It is vital that before you sign off your shipment as delivered clear (taking possession “AS IS”) is to open the box and inspect your product immediately upon arrival. If there is ANY damage(s) to your shipment or any sign of dents, scratches, chips etc. to your unit, you must note this on the Bill of Lading (sign off sheet) If you receive your vehicle with minor damages, please accept the vehicle, take pictures of your of the damages and email to us. Only refuse your vehicle if it sustained structural and frame damages beyond repair, sign the delivery receipt as “refusal due to shipping damages”.
Please report to us immediately to begin in processing your claim.
*With out any notations of damages on the delivery you are “taking possession as is”
So please make sure to inspect your unit. Any receipt without notation of damages will be denied by the shipping company and no claim can be filed.
Please allow 3-4 weeks for delivery for the gas card, and due to high demand on our scooter, free gas card offer valid only when supplies last.

Warranty Policy

All units purchased through superiorpowersports.com come with a 3 months factory warranty. The warranty period will begin the date you receive your vehicle.
The warranty includes:
*Drive train components consisting of engine and transmission
*Electrical and external mechanical parts
The warranty excludes:
*Vehicles that are used in extreme riding, racing or competition, vandalism damage, fire, theft or accident.
*Filters, hoses, lubricants, gaskets, spark plus, plastic parts and components (color coordinated housings, etc.), batteries, brakes, brake handles, seats, lights, belts and tires.
*SuperiorPowersports.com will service your vehicle for warrant, however the customer is responsible to ship or tow-in the vehicle to our facility for service(s) covered under warranty.
*Under no circumstances is any outside repair labor charges, down time.
*Customer is responsible for any towing or shipping charges.

Warranty procedure:
Please call our warranty/technical support to begin warranty claim. The defective warranty part(s) are required by the manufacture to be returned to us and exchanged for new replacement part(s). *Note the defective part(s) will be replaced not the complete vehicle. Returning your defective part(s) will ensure we send you the correct part(s) and assist we in monitoring and correcting potential manufacture defects. Customer satisfaction and your happiness in riding are important to us. We work quickly in-house in all claims so you don’t have to worry about much downtime.

Some Assembly required:
Usually takes about 10-20 minutes. Our Bikes are completely assembled in the factory and fully tested. Battery and the rear mirror are removed after testing. Item will be shipped in a crate, to assemble, put the above items back on. For safety precautions, be sure to check and tighten all nuts and bolts prior to use. Be sure to check for appropriate engine fluid levels to ensure your vehicle is operating under the recommended conditions prior to use any additional questions, please call our tech support at toll FREE 1-888-358-2887.

Remember! You are responsible for performing the setup that a dealer would normally perform - such as putting on rear mirrors, trunk, hooking up the battery, checking tightness of all nuts and bolts, changing oil, etc. Occasionally some units may need other routine items checked/adjusted such as adjusting the carburetor idle and mixture screws, checking to ensure wires are well connected, adjusting chain slack, alignment, and clutch, if needed, this is especially important to any unit purchased without a PDI peformed. While we will gladly assist you with any technical questions. We here at Superiorpowersports.com highly recommend having your unit assembled and tuned by a certified mechanic to make sure everything is done properly. If you do the assembly yourself it is VERY important that you go over everything listed in our maintenance section of our website.

Waiver of liability
The following Waiver of Liability is a legal and biding contract, executed in the State of California.
By purchasing any items on this website, I, as buyer, acknowledge and agree to be above 18 years or age or are the parent of a child under the age of 18 years. I, as buyer, acknowledge and understand that riding an all-terrain-vehicle (ATV), dirt bike, go kart, motorcycle, moped, pocket bike and gas scooter is a dangerous activity that requires strenuous exercise and various degrees of skill and experience for individual riders. I, as buyer, understand that these activities can result in serious injury to the person and damages to property and voluntarily assume any and all risk associated with loss, damage or injury while riding the vehicles advertised on our website. I, as buyer, am aware of the risks, hazards and dangers of personal injury, death and disability inherent with the specific use of these vehicles as well as the inherent risks, hazards and dangers of personal injury and disability increase with inexperienced riders. I, as buyer, agree to release and forever discharge superiorpowersports.com or it’s parent company and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf and the manufacture from any and all claims, actions, damages, liabilities, cost or expenses and attorney fees which are related to, arise out of, or are in any way connected to your participation or use of these vehicles, use of equipment or property supplied by superiorpowersports.com or it’s parent company or your presence upon the premises, whether or not such claims, actions, damages, liability, cost or expenses are caused by the negligence of the seller, manufacture or distributor. By this Agreement, it is my intention as buyer, to surrender and waive any rights to sue or exercise any legal rights to seek damages from superiorpowersports.com or it’s parent company and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf. This Agreement shall be affecting and binding upon my heirs, agents, personal representatives and assigns. I, as buyer, hereby certify that I am over the age of 18 years of age. I, as buyer, have carefully read the foregoing and acknowledge that I understand and agree to all the above Terms and Conditions. I have had the opportunity to ask any and all questions regarding this Agreement and the affect of the same. I, as buyer, am aware that by purchasing this item and sending/remitting payment for it/them, I assume all risk, and waive and release certain substantial rights that I may have or possess. I, as buyer, therefore release all liability and waive all rights I may have in regards to my child’s activities with any items purchased from superiorpowersports.com.

Inaccuracies, Product Variations, and Changes
We make every attempt to accurately list all product information on our website. It is possible; however, that unforeseen typographical errors, picture errors, or inaccurate information may occur. Customers are responsible to research and acknowledge the unit specification directly from the manufacturer. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice, including information pertaining to orders that have already been placed. We apologize for any inconvenience caused by any such errors.

Purchasers Responsibility
You must inspect all equipment before using it and to take full responsibility for assuring that the equipment is in good working order and safe to use. You further understand that you are responsible for damage to equipment. Purchaser understands the nature of motor scooter riding and motorcycle related activities and acknowledges that Purchaser is qualified to operate said motor scooter, and is in proper physical condition to participate in such activity. Purchaser agrees to assume all risks when allowing others to operate Purchaser ' products

Warning! Riding activities of dirt bikes, scooters and ATV’s involve the risk and danger of serious bodily injury including, but not limited to, disability, paralysis, dismemberment and death. These inherent risks and dangers may be caused by Purchasers own actions or inactions, the actions or inactions of others, participating or not participating in the activity, the condition in which the activity takes place, or the negligence of others. There may be additional risks, including social and economic loss, either known or unknown to Purchaser, not readily foreseeable, and Purchaser fully accepts and assumes responsibility for all such risks, losses, costs, and damages incurred as a result of Purchasers participation in motorcycles riding activity.

Operation, Registration, and License
Purchaser is responsible for registering and operating the motorcycles in accordance with local and state laws and ordinances. Seller makes no representations that the motor scooters, dirt bikes and ATVs are legal for operation in your City and State. Customers have read and understood the use of these products before purchasing.

General
Any terms of this Agreement which by their nature extend beyond the Agreement termination in effect until fulfilled, and apply to both of our respective successors and assignees.
